Warranty Policy

This Warranty Policy outlines the terms and conditions governing the warranty coverage provided by POP SPARES LIMITED
(hereinafter referred to as the “Company”) for products purchased through its website.

By purchasing products from the Company, the customer acknowledges and agrees to the terms set forth in this Warranty Policy.

  1. Legal Warranty of Conformity (EU Compliance)

In accordance with applicable European Union legislation, all products sold to consumers are covered by the legal warranty of conformity for a period of 24 months from the date of delivery.

This warranty applies to any lack of conformity existing at the time of delivery and becoming apparent within the warranty period.

Under the legal warranty, the customer is entitled, free of charge, to the restoration of conformity of the product by means of repair or replacement, or, where appropriate, a reduction in price or termination of the contract, in accordance with applicable law.

  1. Commercial Warranty (12 Months)

In addition to the legal warranty, the Company provides a commercial warranty of 12 months from the date of delivery on selected products.

This commercial warranty covers manufacturing defects and functional failures occurring under normal and proper use of the product.

The commercial warranty is provided without prejudice to the consumer’s rights under the legal warranty of conformity.

  1. Scope of Warranty

The warranty covers defects in materials, workmanship, or functionality under normal operating conditions and in accordance with the product’s intended use.

The warranty does not cover:
• damage resulting from misuse, negligence, or improper handling;
• incorrect installation or failure to follow provided instructions;
• normal wear and tear or cosmetic damage;
• damage caused by external factors, including but not limited to power surges, electrical faults, environmental conditions, or accidents;
• unauthorized modifications, repairs, or tampering;
• use of incompatible accessories or third-party components;
• products used for purposes other than those intended.

  1. Installation and System Integration

For products requiring installation or integration into larger systems (including home automation, office, or enterprise solutions), warranty coverage applies only where installation has been carried out in accordance with recommended guidelines or by qualified personnel.

The Company shall not be held responsible for defects or malfunctions resulting from improper installation or system configuration performed by the customer or third parties.

  1. Warranty Claim Procedure

In the event of a defect, the customer must notify the Company without undue delay by contacting:

The customer shall provide:
• proof of purchase (order number or invoice);
• a detailed description of the defect;
• photographic or video evidence where reasonably requested.

The Company reserves the right to request additional information necessary to assess the validity of the claim.

  1. Verification and Inspection

All returned products are subject to inspection and verification by the Company or authorized service partners.

If the defect is confirmed to be covered under warranty, the Company will proceed with the appropriate remedy. If the product is found not to be defective or not covered under warranty, the Company reserves the right to charge inspection, handling, and return shipping costs.

  1. Remedies

Where a valid warranty claim is confirmed, the Company may, at its sole discretion:
• repair the defective product;
• replace the product with an identical or equivalent model;
• offer a partial or full refund, where repair or replacement is not feasible.

Any replacement product may be new or refurbished, provided it is functionally equivalent.

  1. Timeframes

Repairs or replacements will be carried out within a reasonable timeframe, taking into account the nature of the product and the availability of components.

The Company shall not be held liable for delays caused by suppliers, logistics providers, or circumstances beyond its control.

  1. Costs

Where the defect is covered under warranty:
• repair or replacement will be provided free of charge;
• reasonable shipping costs may be covered or reimbursed at the Company’s discretion.

Where the defect is not covered:
• all costs, including shipping, inspection, and repair, shall be borne by the customer.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, loss of profit, business interruption, or any other economic loss arising from the use or inability to use the product.

Nothing in this clause shall limit or exclude liability where such limitation or exclusion is not permitted by law.

  1. Transferability

The warranty applies only to the original purchaser of the product and is not transferable unless otherwise required by applicable law.

  1. Modifications

The Company reserves the right to modify or update this Warranty Policy at any time. Any changes will be effective upon publication on the website.

  1. Governing Law

This Warranty Policy shall be governed by and interpreted in accordance with the laws of Italy.

Any disputes arising in connection with this policy shall be subject to the jurisdiction of the competent Italian courts, without prejudice to mandatory consumer protection provisions.
